Wisheroo is a service of NameNiche, LLC ("Wisheroo", "we", "us" or "our"). These terms cover your use of the Wisheroo website, app, browser extension and the songs, wish lists and reminders we provide. By using Wisheroo you agree to them. If you do not agree, please do not use Wisheroo.
Wisheroo helps you give gifts people will love. You can order a personalized song made from details you share, make a video wish list that family can shop from in secret, save the dates that matter to you and get reminders before them, and save products from online stores to a wish list with our browser extension.
You must be at least 18 to use Wisheroo. You sign in with your email address; there is no password. You are responsible for activity under your account and for keeping access to your email secure. Tell us right away if you think someone else has used your account.
After you confirm your email, we write the lyrics and make your song. Before you pay, you can listen to the first 30 seconds for free and read every lyric. You may ask for a limited number of lyric changes before you approve them. When you pay, we finish and check the song against the lyrics you approved and send you a link to it.
The price shown is the price you pay, with any sales tax already included. Payment is taken at checkout by our payment provider, which sells the song to you as the seller of record, collects any tax, and handles questions about charges under the buyer terms shown at checkout. Prices may change, but a change never affects an order you have already paid for.
Family pack. A family pack includes the song you are buying and one more song for another person, which we write to go with the first. Start the second song from the link in your delivery email or on your song page. Further songs in the same pack are offered at the pack price shown at checkout.
Invite credit. When someone starts their first song from your invite link, they get a credit toward it, and when they pay for it you earn a credit toward your next song, up to the limit shown in the app. Credit is applied automatically at checkout, has no cash value, cannot be transferred or exchanged for money, and is only usable on Wisheroo songs. Inviting yourself, or creating accounts to earn credit, is not allowed, and we may remove credit earned that way. We may change or end the invite program; credit you already earned stays usable for at least 90 days after any change.
Your song is done when the full track sings the lyrics you approved, in the style you chose, with every name pronounced the way you spelled it for us. If the finished song does not meet that definition, tell us within 14 days of delivery and we will re-make it, up to 3 times, until it does. Changes to the lyrics after you approve them are not covered by a re-make. The reveal video is made on your own device from photos you choose, with the song and approved lyrics; it is done when it plays your song with your photos and lyrics. Nothing in these terms limits any right you have under the law where you live.
Only a parent or legal guardian may make a wish list that features a child, and they confirm that role before recording. Anyone with a wish list link can view it and pick a gift; picks are kept secret from the list owner. Family links let the people you send them to add their own birthdays and anniversaries to your calendar; only send them to people who are happy to share those dates with you. The browser extension reads a store page only when you click it, to save that product to your list.
Calls from Santa. A parent or legal guardian may book a call from Santa for their own child, to a mobile number they control and prove with a code. You agree to receive that call, which uses an AI voice, at the time you choose. You stay with your child during the call and can end it at any time. Santa is played by AI and will not promise any gift. If nobody answers, Santa leaves a short message and the call ends.
Some gift ideas and product links are affiliate or partner links, and we may earn a commission if you buy, at no extra cost to you. Products are sold by the stores, not by Wisheroo, and the store's terms apply to your purchase.
You agree not to use Wisheroo to make content that is hateful, harassing, sexual, violent, unlawful, or about a person who would object; to imitate a real artist or reuse an existing song; to share another person's details without the right to do so; to interfere with or test the security of the service without our written permission; or to scrape, copy or resell the service. We may decline any request and remove content that breaks these rules.
You keep the rights you have in the names, memories, videos, photos and other details you give us ("your content"). You confirm you have the right to share it. You give us permission to use your content only to provide and improve the service for you, including writing, producing, checking and delivering your song and showing your wish list to the people you share it with.
Once you pay, you may keep, play, download and share your song, its cover and your reveal video for personal, non-commercial use, including posting them on social media. If you upload your own cover picture, you confirm you have the right to use it. You may not sell the song, register it with a music service, or use it in paid advertising without our written permission.
Lyrics and music are written and produced with AI tools. Each song is checked automatically for the names and approved lyrics; no person listens to it unless you ask us for help. AI-made songs may resemble other works by chance, and may not be protected by copyright in every country.
Wisheroo relies on other companies for things like hosting, payments, email, music production and analytics. Links to other websites and stores are provided for convenience, and we are not responsible for their content, products or policies.
The Wisheroo name, logo, website, app, extension and software belong to NameNiche, LLC and are protected by law. Apart from the rights to your song in section 10, these terms do not give you any right to use them.
Wisheroo is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose. We do not promise that the service will always be available or free of errors, or that a recipient will react to a gift in any particular way.
To the fullest extent the law allows, NameNiche, LLC is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the greater of the amount you paid us in the 3 months before the claim or US$100.
You agree to defend and hold NameNiche, LLC harmless from claims arising from content you give us or your breach of these terms.
You can delete your account at any time from the You page in the app. We may suspend or end access for anyone who breaks these terms. Sections 9 to 16 and 19 continue after termination.
We may update these terms. We will post the new effective date above, and for material changes we will tell you by email or in the app before they take effect. Continuing to use Wisheroo after a change means you accept it.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Broward County, Florida, and you and we consent to their jurisdiction.
